§01 General

§02 DELIVERY OF SERVICE
Delivery of parcels normally occurs between 13:00-22:00 on weekdays, Saturdays, and Sundays in the state of New York and California. Flype AB never charges for the normal delivery, the consumer purchases this directly from the merchant.
§03 PAYMENT
Flype offers payments through Shopify. The consumer has the option to select several payment options including credit card and bank wire transfer.
§04 RIGHT TO WITHDRAW
The consumer has no right to withdraw once the time slot has been purchased.
§05 REFUND
If Flype fails to deliver within the purchased time interval, Flype will refund the payment to the consumer via Shopify. No consumer will pay for a service Flype has not been able to deliver.
§06 COOKIES
A cookie is a text file that the website you are visiting is requesting to be saved on your computer. Cookies are used on many websites to give visitors access to various features. The information in a cookie can be used to track a user’s browsing. According to the Electronic Communications Act (July 25, 2003), anyone who visits a website with cookies should be informed about:

This website uses two types of cookies. One type saves a file permanently on your computer, which is used to measure, e.g. how you as a visitor navigate on the website. This is to offer the visitor better services and service. The information stored on your computer is only a unique number. The second type of cookie that is commonly used is “Session Cookie”. While you are visiting the site, our web server shares a unique identification string to be able to separate you from other visitors. This “Session Cookie” is used to be able to follow what you do on the site, keep track of your login and if something is placed in the shopping cart, measure traffic, exposure and analysis of marketing efforts, etc. A “Session Cookie” is never permanently stored on your computer and disappears when you close your browser. Sometimes we use third-party cookies to e.g. analyze how we can optimize our website or to display ads and recommend products for you when you visit other websites on the internet. §07 PERSONAL INFORMATION
Flype AB is responsible for the processing of the personal data that we collect about you. This information is transferred from the merchant who booked the delivery as well as directly from you.
Information we collect includes name, telephone number, e-mail, delivery address. With delivery outside the door, we can take pictures for quality assurance. When communicating with you, we save metadata about the communication. Calls may be recorded for educational purposes. When delivering with signature requirements from the sender, we store your signature.
We may transfer your personal data to our business partners who process personal data on Flype AB’s behalf for the purposes described in this policy and thereby may have temporary access to personal data. Your information is stored only as long as it is required to perform our service (for example, to fulfill an agreement or to fulfill quality assurance) or as long as it is prescribed by law.

§08 FORCE MAJURE
Flype AB shall not be liable for any failure or delay in the performance of this agreement for the period that such failure or delay: a.) is beyond the reasonable control of a party, b.) materially affects the performance of any of its obligations under this agreement, and c. could not reasonably have been foreseen or provided against, but will not be excused for failure or delay resulting from only general economic conditions or other general market effects. These circumstances include, but are not limited to: war, riot, fire, natural disasters (flood, hurricane, earthquake), snowstorm or other weather condition or happening that makes roads impassable or by Flype important infrastructure unusable, explosions, strike, or new laws forbidding pursuance of the Agreement.
